I have voluntarily enrolled in a martial arts, cultural arts, fitness, educational, or recreational program offered by Seichou Karate^® Ltd. (SKL). Such programs may involve strenuous physical activity and rigorous cardiovascular exercise and may include, but are not limited to, indoor, outdoor, and online instruction, fitness activities, yoga, meditation, cultural education, language instruction, field trips, camps, transportation, demonstrations, competitions, and related activities. The specific activities included in any SKL program may vary from time to time, and I understand that not every activity described herein will be offered in every program.

I fully understand and agree that the martial arts component of this program is a contact sport requiring participants to kick, punch, strike, flip, throw and sweep, and be kicked, punched, struck, flipped, thrown and swept by other students during sparring (kumite and randori) sessions. I understand that participation in online classes involves additional risks, including the absence of direct instructor supervision, and I assume responsibility for maintaining a safe training environment while participating remotely.

I also acknowledge and agree that participation in activities at SKL’s premises, online programs, off-site events, and outdoor activities involves health risks, including exposure to and infection with communicable diseases, infections, and illnesses, including but not limited to COVID-19, influenza, MRSA, and other contagious conditions.

I knowingly and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with participation in SKL programs and activities.

In view of this, I understand that I may sustain illness and injury, including death, from participation, and that I must read and adhere to the Seichou Sparring Rules and Safety Guidelines, which are available at www.seichoukarate.com. In view of this, I represent that I am in good physical condition and am not under order of any doctor that would prevent or limit my participation in SKL programs. To the extent that I feel that my participation in these programs might be inadvisable for health reasons, I have consulted a medical doctor.

I hereby release SKL and Personal Growth Corporation (PGC), their owners, employees, instructors, volunteers, and contractors from all liability arising now or in the future including, but not limited to, heart attacks, bodily soreness, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, injuries to the head, knee, lower back, feet, and exposure to and infection with bacteria and viruses, such as communicable diseases, infections, and illnesses, or death, however caused, occurring during or after participation in SKL programs. This release applies to claims arising from ordinary negligence but shall not apply to gross negligence or willful misconduct to the extent prohibited by applicable law.

CONSENT TO EMERGENCY PROCEDURES

In the event of injury, I authorize SKL to undertake the following emergency procedures on my behalf: (1) administer emergency first aid, (2) summon medical professionals to attend to me, (3) contact my emergency designee, and (4) transport me to a medical facility of SKL’s choice. I understand that transportation by motor vehicle involves risks of injury, illness, disability, property damage, and death, and I voluntarily assume those risks. If I cannot be reached or am unable to communicate, I authorize emergency medical personnel to provide treatment deemed necessary. I agree that I will be responsible for all costs arising from my treatment.

PROMISE TO REFRAIN FROM VIOLENT ACTS

I understand that the purpose of the martial arts training program that I will undertake is to develop greater mental and physical self-control. I understand that the techniques taught by SKL are intended solely for lawful purposes, including personal development, sport, and legitimate self-defense, and I agree not to use such techniques unlawfully or criminally.

CONSENT TO USE LIKENESS OR IMAGE

I consent to the use of any likeness, photographic, videographic, or digital image taken of me by SKL, its clients and agents for commercial sale or promotional use. I waive any rights that I might have to compensation for the sale or use of such material by SKL.

LOSS OF PERSONAL PROPERTY

SKL is not responsible for lost, stolen, or damaged personal property brought onto its premises or to any SKL event.

INSURANCE COVERAGE

I understand that SKL does not provide health, accident, disability, or life insurance coverage for participants and that I am responsible for maintaining any insurance I deem necessary.

AGREEMENT TO HOLD HARMLESS

I understand the nature and extent of the risks inherent in participating in SKL’s cultural and martial arts programs and in using its facilities, and I voluntarily assume those risks. I agree that I will be solely responsible for any loss or damage, including personal injury, property damage or death, that I sustain while participating in SKL programs or using its facilities.

I understand that this document constitutes a release of liability, assumption of risk, indemnification agreement, and covenant not to sue. Should SKL, or anyone acting on its behalf, incur attorney’s fees or costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

In consideration of my participation in SKL programs or access to its facilities, I agree to indemnify and hold harmless SKL and PGC, its owners, employees, instructors, volunteers, and contractors from any cause of action, claim, demand, loss, or cost of any nature whatsoever arising out of or in any way related to my program participation or access to SKL facilities.

This release and indemnification shall be binding upon me and my heirs, executors, administrators, personal representatives, successors, and assigns.

SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT AND AGREEMENT

I have carefully read this document and voluntarily sign it. I further agree that no oral representations, statements or inducements apart from this written agreement have been made. I am aware that by agreeing to this agreement I am giving up valuable legal rights, including the right to recover damages from SKL and PGC, its owners, employees, instructors, volunteers, and contractors.

If signing on behalf of minors, the parent or legal guardian also understands that this agreement is made on their behalf and on behalf of any minor child or legal ward for whom I am authorized to act. In that case, I warrant to SKL that I have full authority to sign this agreement on their behalf. I further agree to indemnify and hold harmless SKL and PGC from any claim brought by or on behalf of the minor participant arising from participation in SKL activities.

I agree that this document shall be interpreted and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located in Fairfax County, Virginia.

I hereby affirm that I have read, understand and fully assent to the foregoing.
